As per NOTE (ii) under Paragraph 11 on Page No. 2 of initial advertisement No. CRPD/CR/2009-10/04, SBI clarified that :-
“Depending upon the number of vacancies only a certain number of candidates from amongst those who qualify by ranking high enough in the merit will be called for interview and / or proficiency test in the ratio of maximum 3 candidates for each vacancy.”
By this, we can say that the vacancies increased from 11,000 to around 30,000.

Dear ex-servicemen,
I am also an ex-serviceman from Indian Army, Corps of Military Police; retired wef 01 Sep 1998.
I have firm evidences that SBI dishonored existing legal rights of ex-servicemen for 14.5% reservation in Banking Sector.
If we check SBI initial recruitment advertisement NO. CRPD/CR/2009-10/04 of 23rd July 2009, we find it that they advertised different percentages of reservation for ex-servicemen category in different state with different yard-sticks. They advertised less percentage reserved in some States like Gujarat 10%, Karnakata 10%, Madhya Pradesh 10.09%, Chhattisgarh 9.8%, Orissa 10%, Tamilnadu 10%, Pondicherry 10%, Manipur 10%, Mizoram 10%, West Bengal 9.96, Sikkim 8.57%, Maharashtra 9.37%, Goa 9.09%, Kerala 10%, Lakshdweep 10% WHEREAS in their favorite States they reserved near to 14.5% vacancies which are Chandigarh 14.58%, Punjab 14.5%, J&K 14.28%, Haryana 14.5%, Himachal Pradesh 14.51%, Assam 14.54%, Meghalaya 15%, Arunachal Pradesh 14.28%, Nagaland 16%, Tripura 13.33%, Andhra Pradesh 14.44%, A&N Islands 13.63%, UP 14.55%, Delhi/Noida/Haryana 14.44%, Rajasthan 14.49%, Uttarakhand 14.47%, UP (Western) 14.59%, Bihar 14.36, Jharkhand 14.28%.
Actually, if we proceed legally, the following are authorities which clears 14.5% reservation for ex-servicemen :-
- In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India, the President, enacted ‘Ex-servicemen (Re-Employment in Central Civil Services and Posts) Rules, 1979′ by publishing Gazette Notification of 1st March, 1986.
- Rule 6A for ‘Lower Standard for Selection’ for ex-servicemen to make deficiency in the reserved quota.
- Existence of 14.5% reservation in Banking Sector in ‘Hand-Book on Resettlement of Ex-servicemen’ published by Director General Resettlement, Ministry of Defence, published in 1995.
- Ministry of Defence letter No.2667/DGR/Emp-3 dated 24/04/95 addressed to The Special Secretary, Ministry of Finance, Deptt. of Economic Affairs, Banking Division.
- Government of India – Banking Division (Government of India (Banking Division) letter of June 1997.
- Paragraph 2 on the reserve side of the Proforma of the Banking Division letter referred above clarifies that the reservation for ex-servicemen is horizontal reservation and these vacancies are part of the total indent for General, SC, ST and OBC.
- Paragraph 3 on the same page of the Banking Division letter referred above states that not more than 50% of the total number of vacancies in a year would be reserved for all categories, namely, SC, ST & OBC.
- Paragraph 4 on the same page of the Banking Division letter referred above explains that reservation for ex-servicemen will be provided from amongst the community they belongs to SC/ST/OBC or General Category, he should be adjusted against one of the vacancy earmarked for that category so that, the total reservations should not exceed of 50% of the total vacancies.
- As per the Supreme Court Order on 27% reservation provided to OBC category, Government of India, clarified vide their letters dated 1st December, 1994 and 24th August, 1995 that the percentage of reservation for ex-servicemen should remain the same as at present, that is to say that there is no change to reservations catered for the ex-servicemen.
- The then Defence Minister Shri P.V.Narasimha Rao initiated a letter in 1985 on implementation of High Level Committee recommendations regarding monitoring systems to ensure that the reserved vacancies are filled by ex-Servicemen vide their letter No.2219/85/RM dated 23/03/85.
- Shri P.V.Narasimha Rao, in the capacity of Prime Minister of India, again initiated a DO letter in 1995 to the Chief Ministers of the All States and the Lt. Governors of the Union Territories regarding carry forward of the reserved vacancies for ex-servicemen for a period of at least one year before they are de-reserved and introducing an effective monitoring system vide their DO letter dated 01/11/95.
- The then Raksha Mantri Shri Mulayam Singh Yadav initiated a DO letter in 1996 regarding establishment of ‘ex-Servicemen Reservation Monitoring Cell’ to get the result that ex-Servicemen get full benefit of reservation policy so that ONLY ex-Servicemen should be recruited against vacancies exist for the ex-Servicemen vide their DO letter dated 11/10/96.
- Ministry of Defence, vide their letter No.2667/DGR/Emp-3 dated 24/04/95, clearly instructed to keep a proper watch on the recruitment notifications issued from time to time by the Central Govt employers and any discrepancies on reservation of posts for ex-Servicemen may be intimated to the Dte General Resettlement, Ministry of Defence for taking up the matter with the concerned organization.
- Order of the High Court of Gujarat at Ahmedabad in MY Special Civil Application No. 4651 of 1999 against B.S.R.B. (Banking Service Recruitment Board), which can be view by clicking the undermentioned web-link of Gujarat High Court :-

- Important lines of the Judgement delivered by the High Court of Gujarat at Ahmedabad in MY Special Civil Application No. 4651 of 1999 against B.S.R.B. (Banking Service Recruitment Board):-
“In view of the aforesaid submissions, I am of the view that the respondent-Board has failed to keep 14.5% reservation for ex-servicemen which is statutorily provided by way of provision of Constitution.”
- Government of India (Banking Division) letter dated 11th May, 1988.
Based on these and more legal authorities, all un-selected ex-servicemen, if interested, ask the information under “Right to Information Act 2005” which entitles us to inspect the work, document, records, taking notes, extracts or certified copies of documents / records and certified samples of the materials and obtaining information which is also stored in electronic form; within the MAXIMUM 30 days time-frame. Applicant has to remit the prescribed fee of Rs.10/- by way of a Bank Draft / Bankers cheque / IPO favouring State Bank of India and payable Mumbai. Alternatively, one may deposit a sum of Rs.10/- in “P&T” account at any of State Bank of India Branch and enclose the counterfoil thereof in original with the application. As per my view, the undermentioned may be asked for further legal process :-
(a) The competent authorerwiseity of the recruitment advertisement has acted in contravention to Ministry of Defence letter No.2667/DGR/Emp-3 dated 24/04/95 addressed to The Special Secretary, Ministry of Finance, Deptt. of Economic Affairs, Banking Division; or otherwise ?
(e) Are you agreed with that as per the Banking Division (Government of India (Banking Division) letter of June 1997, current reservation with regard to ex-servicemen is 14.5%; or otherwise ?
(f) Are you agreed with that as per the Paragraph 2 on the reserve side of the Proforma of the Banking Division letter referred at paragraph 2 (e) above clarifies that the reservation for ex-servicemen is horizontal reservation and these vacancies are part of the total indent for General, SC, ST and OBC; or otherwise ?
(g) Are you agreed with that as per the Paragraph 3 on the same page of the Banking Division letter referred at Paragraph 2 (e) above states that not more than 50% of the total number of vacancies in a year would be reserved for all categories, namely, SC, ST & OBC; or otherwise ?
(h) Are you agreed with that as per the paragraph 4 on the same page of the Banking Division letter referred at Paragraph 2 (e) above explains that reservation for ex-servicemen will be provided from amongst the community they belongs to SC/ST/OBC or General Category, he should be adjusted against one of the vacancy earmarked for that category so that, the total reservations should not exceed of 50% of the total vacancies; or otherwise ?
(i) My contention that as per the Supreme Court Order on 27% reservation provided to OBC category, Government of India, clarified vide their letters dated 1st December, 1994 and 24th August, 1995 that the percentage of reservation for ex-servicemen should remain the same as at present, that is to say that there is no change to reservations catered for the ex-servicemen; is baseless or evidence-based?
(j) Is The General Manager, Central Recruitment & Promotion Department, State Bank of India, Mumbai – 400 021 or any other authorized authority, aware that the then Defence Minister Shri P.V.Narasimha Rao initiated a letter in 1985 on implementation of High Level Committee recommendations regarding monitoring systems to ensure that the reserved vacancies are filled by ex-Servicemen vide their letter No.2219/85/RM dated 23/03/85; or otherwise?
(k) Is The General Manager, Central Recruitment & Promotion Department, State Bank of India, Mumbai – 400 021 or any other authorized authority, aware that Shri P.V.Narasimha Rao, in the capacity of Prime Minister of India, again initiated a DO letter in 1995 to the Chief Ministers of the All States and the Lt. Governors of the Union Territories regarding carry forward of the reserved vacancies for ex-servicemen for a period of at least one year before they are de-reserved and introducing an effective monitoring system vide their DO letter dated 01/11/95; or otherwise?
(l) Is The General Manager, Central Recruitment & Promotion Department, State Bank of India, Mumbai – 400 021 or any other authorized authority, aware that the then Raksha Mantri Shri Mulayam Singh Yadav initiated a DO letter in 1996 regarding establishment of ‘ex-Servicemen Reservation Monitoring Cell’ to get the result that ex-Servicemen get full benefit of reservation policy so that ONLY ex-Servicemen should be recruited against vacancies exist for the ex-Servicemen vide their DO letter dated 11/10/96; or otherwise?
(m) Is The General Manager, Central Recruitment & Promotion Department, State Bank of India, Mumbai – 400 021 or any other authorized authority, aware that Ministry of Defence, vide their letter No.2667/DGR/Emp-3 dated 24/04/95, clearly instructed to keep a proper watch on the recruitment notifications issued from time to time by the Central Govt employers and any discrepancies on reservation of posts for ex-Servicemen may be intimated to the Dte General Resettlement, Ministry of Defence for taking up the matter with the concerned organization; or otherwise?
(n) Has The General Manager, Central Recruitment & Promotion Department, State Bank of India, Mumbai – 400 021 or any other authorized authority, gone through thoroughly in the Order of the High Court of Gujarat at Ahmedabad in MY Special Civil Application No. 4651 of 1999, which is provided vide my two communications referred at paragraph 1 above; or otherwise?
(o) Has The General Manager, Central Recruitment & Promotion Department, State Bank of India, Mumbai – 400 021 or any other authorized authority, gone through thoroughly in the Order of the High Court of Gujarat at Ahmedabad in MY Special Civil Application No. 4651 of 1999 against B.S.R.B. (Banking Service Recruitment Board), by clicking the undermentioned web-link of Gujarat High Court, which is provided vide my two communications referred at paragraph 1 above; or otherwise?

(p) Has The General Manager, Central Recruitment & Promotion Department, State Bank of India, Mumbai – 400 021 or any other authorized authority, clearly understands the meaning of the following few lines of the Judgement delivered by the High Court of Gujarat at Ahmedabad in MY Special Civil Application No. 4651 of 1999 against B.S.R.B. (Banking Service Recruitment Board); or otherwise? “In view of the aforesaid submissions, I am of the view that the respondent-Board has failed to keep 14.5% reservation for ex-servicemen which is statutorily provided by way of provision of Constitution.”
(q) Is The General Manager, Central Recruitment & Promotion Department, State Bank of India, Mumbai – 400 021 or any other authorized authority, aware that in exercise of the powers conferred by the proviso to Article 309 of the Constitution of India, the President, enacted ‘Ex-servicemen (Re-Employment in Central Civil Services and Posts) Rules, 1979′ by publishing Gazette Notification of 1st March, 1986; or otherwise?
(r) Is The General Manager, Central Recruitment & Promotion Department, State Bank of India, Mumbai – 400 021 or any other authorized authority, aware the contents of Government of India (Banking Division) letter dated 11th May, 1988; or otherwise?
(s) Is The General Manager, Central Recruitment & Promotion Department, State Bank of India, Mumbai – 400 021 or any other authorized authority, aware about Rule 6A for ‘Lower Standard for Selection’ for ex-servicemen to make deficiency in the reserved quota; or otherwise?
(t) Is The General Manager, Central Recruitment & Promotion Department, State Bank of India, Mumbai – 400 021 or any other authorized authority, aware about the Supreme Court Order (the Hon’ble Supreme Court ruling on 27% reservation provided to OBC category) clarification by Government of India, vide their letters dated 1st December, 1994 and 24th August, 1995 that the percentage of reservation for ex-servicemen should remain the same as at present, that is to say that there is no change to reservations catered for the ex-servicemen; or otherwise?
(u) Is The General Manager, Central Recruitment & Promotion Department, State Bank of India, Mumbai – 400 021 or any other authorized authority, aware about existence of 14.5% reservation in Banking Sector in ‘Hand-Book on Resettlement of Ex-servicemen’ published by Director General Resettlement, Ministry of Defence, published in 1995; or otherwise?
(v) Is The General Manager, Central Recruitment & Promotion Department, State Bank of India, Mumbai – 400 021 or any other authorized authority, aware about Orders of Government of India – Banking Division (Government of India (Banking Division) letter of June 1997 which clearly states that current reservation with regard to ex-servicemen is 14.5%, Paragraph 2 on the reserve side of the Proforma clarifies that the reservation for ex-servicemen is horizontal reservation & these vacancies are part of the total indent for General, SC, ST and OBC, Paragraph 3 on the same page, states that not more than 50% of the total number of vacancies in a year would be reserved for all categories, namely, SC, ST & OBC and further, paragraph 4 on the same page No. 2 explains that reservation for ex-servicemen will be provided from amongst the community they belongs to SC/ST/OBC or General Category, he should be adjusted against one of the vacancy earmarked for that category so that, the total reservations should not exceed of 50% of the total vacancies; or otherwise? Does The General Manager, Central Recruitment & Promotion Department, State Bank of India, Mumbai – 400 021 or any other authorized authority know horizontal & vertical reservation concept in the light of judgment delivered by Supreme Court in Indira Swahney’s case? Is The General Manager, Central Recruitment & Promotion Department, State Bank of India, Mumbai – 400 021 or any other authorized authority able to draw correct reservation position / table for the advertised vacancies as per the Supreme Court’s guidelines? If yes, then why they have not drawn / published the correct reservation table in the initial recruitment advertisement? If no, can they believe that an un-selected candidate for clerk post like me, can prepare / draw / provide correct reservation table as per Supreme Court’s guidelines with percentage & Numbers of each category without any mistake? Is there any un-willingness towards transparency to prepare / publish correct reservation table in the initial recruitment advertisement or lack of knowledge about horizontal & vertical reservation inter-locking concept?
(w) Have The General Manager, Central Recruitment & Promotion Department, State Bank of India, Mumbai – 400 021 or any other authorized authority advertised the 14.5% vacancies for ex-servicemen in the recent recruitment process of clerical staff VIDE ADVERTISEMENT NO. CRPD/CR/2009-10/04; or otherwise? Please provide the total numbers of vacancies advertised alongwith total numbers of vacancies announced for ex-servicemen including backlog for ex-servicemen; state-wise. Why back-log vacancies for ex-servicemen not shown in the recruitment advertisement? Why only 10% vacancies shown reserved for ex-servicemen in Gujarat State? As per the existing rules, 14.5% vacancies of the total vacancies must reserve for ex-servicemen. To fill up all the 14.5% vacancies reserved for ex-servicemen, there is a Rule 6-A for Lower Standard for Selection for ex-servicemen. It is similar applicable as being used in written test where minimum passing marks for SC/ST/OBC/PH/XS are 35% whereas for Open category these are 40%. Paragraph 17 on Page 7 of your Booklet “Prepare your-self” clearly clears the concept of Lower Standard for Selection for ex-servicemen. Have The General Manager, Central Recruitment & Promotion Department, State Bank of India, Mumbai – 400 021 or any other authorized authority adopted the similar Lower Standard for selection for ex-servicemen for interview & prepared final list accordingly? Please provide detailed information in this regard as it seems that this is not being done while preparing final selection list for ex-servicemen.
(x) Have The General Manager, Central Recruitment & Promotion Department, State Bank of India, Mumbai – 400 021 or any other authorized authority reserved the 14.5% vacancies for ex-servicemen in the recent recruitment process of clerical staff VIDE ADVERTISEMENT NO. CRPD/CR/2009-10/04; or otherwise? Please provide the total numbers of vacancies reserved alongwith total numbers of vacancies reserved for ex-servicemen including backlog for ex-servicemen; state-wise & Category-wise.
(y) Please provide total numbers of candidates appeared in the written examination alongwith numbers of ex-servicemen candidates appeared in the written examination; state-wise & Category-wise. Please provide Serial Number (Place) in the particular merit list prepared for interview for General Category ex-servicemen of Gujarat for roll No. Gen-XS 3615016722 including marks obtained in the written test out of total marks including cut-off marks of the merit-list.
(z) Please provide details of cut-off marks of all 200 independent Merit Lists as advertised by The General Manager, Central Recruitment & Promotion Department, State Bank of India, Mumbai – 400 021 vide their Advertisement No. CRPD/CR/2009-10/04 of 23rd August 2010.
(aa) Please provide total numbers of candidates merit-listed on successful clearance in the written examination alongwith numbers of ex-servicemen candidates merit-listed on successful clearance in the written examination, including cut-off marks; state-wise & merit-list-wise. Please clarify that how many candidates above roll No. Gen-XS 3615016722 and how many candidates below roll No. Gen-XS 3615016722 in the particular merit list prepared for interview for General Category ex-servicemen of Gujarat including marks obtained in the written test out of total marks including cut-off marks of the final merit-list for interview. Please provide numbers of candidates called / appeared for interview; separately for each merit-list which are 200 merit-lists.
(bb) Please provide details of all 200 independent Merit Lists prepared for interview including cut-off marks for each merit-list as advertised by The General Manager, Central Recruitment & Promotion Department, State Bank of India, Mumbai – 400 021 vide their Advertisement No. CRPD/CR/2009-10/04 of 23rd August 2010.
(cc) Please provide details of all independent Merit Lists prepared for interview meant for ex-servicemen including state-wise cut-off marks as advertised by The General Manager, Central Recruitment & Promotion Department, State Bank of India, Mumbai – 400 021 vide their Advertisement No. CRPD/CR/2009-10/04 of 23rd August 2010.
(dd) Please provide details of all 200 independent Merit Lists prepared after interview for final selection including cut-off marks for each merit-list as advertised by The General Manager, Central Recruitment & Promotion Department, State Bank of India, Mumbai – 400 021 vide their Advertisement No. CRPD/CR/2009-10/04 of 23rd August 2010.
(ee) Please provide details of all independent Merit Lists prepared after interview for final selection meant for ex-servicemen including state-wise cut-off marks as advertised by The General Manager, Central Recruitment & Promotion Department, State Bank of India, Mumbai – 400 021 vide their Advertisement No. CRPD/CR/2009-10/04 of 23rd August 2010. Please clarify that how many candidates above roll No. Gen-XS 3615016722 and how many candidates below roll No. Gen-XS 3615016722 in the particular merit list prepared after interview for final selection for General Category ex-servicemen of Gujarat including aggregate marks obtained in the written test as well as in interview out of total marks including cut-off marks of the final merit-list for selection.
(ff) Why The General Manager, Central Recruitment & Promotion Department, State Bank of India, Mumbai – 400 021 or any other authorized authority advertised different percentages of reservation for ex-servicemen category in different state with different yard-sticks? While providing detailed legal evidences, please don’t ignore providing numbers of actually filled-in vacancies announced reserved; separately 200 independent merit-list-wise so that clear-cut irregularities can come-out.
(gg) As per the Note ii) under paragraph 11 (b), of your initial recruitment advertisement, ‘only a certain number of candidates from amongst those who qualify by ranking high enough in the merit will be call for interview and / or proficiency test in the ratio of maximum 3 candidates for each vacancy’ clears that if, as per your Advertisement No. CRPD/CR/2009-10/04, around 90000 candidates were interviewed, have you implemented your own rules while declaring final list for selection? Please give detailed explanation to proceed further.
(hh) At the end of the recruitment process, how many reserved but un-filled vacancies meant for ex-servicemen carried forwarded for a period of at least one year before they are de-reserved, as per the then Prime Minister Shri P.V. Narasimha Rao DO letter dated 01/11/95?
(ii) Please provide last 5 recruitment process details of ex-servicemen backlog in the light of the above paragraph.
(jj) Is The General Manager, Central Recruitment & Promotion Department, State Bank of India, Mumbai – 400 021 or any other authorized authority in belief that any eligible person like me (who is capable to initiate such communication & who fought against B.S.R.B. & achieved firm judgment from Gujarat High Court for 14.5% reservation for ex-servicemen in Banking Sector); if absorbed; may prove himself as an asset to the organization: or otherwise?
